Ohio is a no-fault divorce state. This means that you do not have to prove that your spouse did something wrong to file for divorce. Occasionally, clients ask me if they should hire a private investigator to follow their spouse around and collect evidence of infidelity and other bad behavior. I tell my clients that they can, but it will not have much influence on the outcome of their divorce case. If parties agree to go their separate ways prior to filing a divorce complaint, they can obtain a dissolution of their marriage.

Ohio is an "equitable division" state when it comes to dividing marital assets and debts. However, equitable division does not necessarily mean equal division. Spousal support or alimony may be awarded in long-term marriages when there is a significant difference in income between the parties.
In any divorce case, it's important to be familiar with the judge and the other side's attorney so you can know what to expect going into your divorce. Sometimes, you need to be aggressive to get the settlement you want.
